主旨： 函轉內政部有關公職人員選舉罷免法第二十六條條文修正，業奉總統以 115 年 7 月 1 日華總一義字第 11500059321 號令公布一案，請查照。
說明：
一、 依據內政部 115 年 7 月 2 日台內民字第 1150126319 號函辦理。
二、 本次公職人員選舉罷免法第二十六條條文修正，主要有二項重點，摘要內容如下：
(一) 第 6 款新增「詐欺犯罪危害防制條例」：凡犯該條例之罪，經有罪判決確定者，不得登記為候選人。將重大詐欺犯罪納入候選人消極資格限制，以提升公職人員誠信及維護民主選舉公信力。
(二) 第 9 款刪除原「緩刑期間不得登記為候選人」限制，並增列「宣告緩刑或得易服社會勞動之自由刑者，不在此限」，使經法院宣告緩刑或依法得易服社會勞動者，得依法登記參選。
(三) 除上述二項修正外，其餘包括內亂、外患、貪污、賄選、國家安全、組織犯罪、毒品、槍砲、洗錢、褫奪公權、受監護或輔助宣告等不得登記為候選人的規定均維持現行制度，未作修正。
